Leases

What is a lease?

A lease is a legal agreement between a tenant and a landlord which sets out all of their legal rights and responsibilities in relation to the possession and ownership for a particular piece of land.  Entering a new commercial, retail or residential lease gives rise to legal obligations which can create confusion and uncertainty.  It is necessary to obtain legal advice if you are drafting or entering a commercial, retail or residential lease, or involved in a lease dispute.

What can go wrong with a lease?

If you are a landlord and your lease is not properly drafted, problems can emerge for you in relation to enforcing the payment of rent, reimbursement for damage to property, the ability to remove tenants from a property if they are not caring for it or paying rent appropriately and other related problems.  You can even have a dispute with the tenant in the Consumer Tenancy Tribunal  New South Wales with the tenant and if your lease is not watertight, you may loose and need to pay the legal costs of the litigation to the tenant.

If you are a landlord, and you do not have a written lease you face having your rights taken away to possession of the property with little or no recourse.  If you do not negotiate appropriate terms to a lease for you and your business you may be forced to accept terms which are very unfavourable for your business.  This could strangle your business to the point that you are no longer able to operate effectively in your property.
